CCR/Rules Quick Guide
NOTE: This is a quick reference guide for only the most common items and is not all inclusive of the Rustic Creek Covenants, Conditions, and Restrictions (CCR). For a copy of the complete CCR and amendments contact the Board of Directors at rusticcreekhoa@gmail.com

Restricted or Prohibited Actions/Activities and Design Review Guide (alphabetically for quick reference):
Accumulation – The accumulation of rubbish, trash, or garbage except in approved containers between regular garbage pickups is prohibited.
Address Numbers – no approval required if numbers are no larger than 6”
Air Conditioners and fans – no window units shall be visible from the street
Birdfeeders – no restrictions
Clotheslines – clotheslines must not be visible from the street
Burning – burning is allowed but must be controlled and attended at all times. No burning during a burn ban issued by appropriate authority. The Board may restrict burning in conditions that don’t rise to the level of an official burn ban.
Combustible materials – no on-site storage of gasoline, heating, or other fuels except a reasonable amount of fuel for emergency purposes or operation of lawn mowers and similar tools/equipment.
Construction Activities – limited to daytime working hours (7:00 AM to 7:00 PM Monday through Saturday)
Decks – only in backyard and must be kept in good repair
Dog houses – no restrictions except must be in the back yard only
Dog run – no restrictions except must be in the back yard only
Driveways – Driveways in front of the residence leading to the primary residence’s attached garage must be concrete. All other driveways must be a hard surface (concrete, gravel, asphalt etc.) at the discretion of the property owner.
Dumping – no dumping grass clippings, leaves, debris, petroleum products, fertilizers, or other potentially hazardous or toxic substances. Fertilizers, pest spray etc. may be used on lawns provided care is taken to minimize runoff.
Exterior colors – exterior colors must be complimentary to the rest of the neighborhood
Fences – 6’ tall wooden privacy fence of the property owner’s choosing is authorized without any Board approval excluding the front yard. Any other fencing, visible from the street, or to be placed in the front yard, must be approved prior to installation. Fencing not visible from the street is at the property owner’s discretion,
Fireworks, firearms and explosives – no restrictions except for state law and common-sense safety considerations.
Flags and flag poles – no restrictions
In General – any activity that emits foul or obnoxious odors or creates noise or other conditions that disturb the peace, or violates local, state, or federal law are not allowed.
Investment uses – lots may not be used for time sharing, fraction sharing, or similar programs
Leasing – leased lots within Rustic Creek shall not exceed 40% - lots will be permitted to be leased upon “first bona fide request, first permitted basis” . If you are a property owner planning to lease a property you must notify the Board.
Lights, lighting, alarms, security lighting – No spotlights, floodlights, motion lights, and other high intensity lighting or alarms shall be placed or utilized upon any lot in a manner which unreasonably interferes with the enjoyment of adjoining lots.
Metal Shops – metal shops are allowed. Design, location, and color must receive Board approval prior to installation. No size restrictions.
Outbuildings – all outbuildings must receive Board approval prior to installation
Parking – No parking any vehicles on the street overnight. Parking of inoperable or stored vehicles must be in the back yard unless they are not a nuisance to others.
Pets – No raising, breeding, or keeping of animals, or livestock, without prior Board approval except that a reasonable number of dogs, cats, or other usual and common household pets are permitted. Even if someone else in the neighborhood already has the animals you want (like chickens) you are still required to file a request.
Pets that are permitted to roam free, make objectionable noise, endanger health and safety or are a nuisance to other residents shall be removed at the request of the Board.
Dogs shall be leashed or under complete control of the owner when not in a fenced yard.
PETS SHALL NOT BE CHAINED/TIED DOWN EXCEPT FOR TEMPORARY SITUATIONS (such as a fence repair).
Pools – Small children’s pools are permitted in the front yard if they are not permanent. No permanent pools shall be constructed in the front yard. Any permanent pool (above ground or in ground) must be in the back yard and must be secured from unsupervised child access according to the recommendations of the U.S. Consumer Product Safety Commission’s Safety Barrier Guidelines for Residential Pools. All pools must be kept in good repair.
Recreational structures – gazebos, pool houses, and similar recreational structures are allowed in the backyard only without Board approval.
Solar devices – at the property owner’s discretion
Statues, sculptures, fountains, and ponds – if placed in the front yard must receive BOARD approval prior to installation
Trash and Garbage receptacles – to be kept next to the residence when it’s not trash pickup day. Must be put back next to the house within 2 days of trash day. No trash or garbage shall be visible from other lots except the 24 hours leading up to trash pickup day. No incinerators shall he kept or maintained on any lot. No refuse pile, garbage, or unsightly objects shall be allowed to be placed, accumulated, or suffered to remain anywhere on a lot.
Treehouses – treehouses are allowed in back yards only
Walls and terracing – All walls of any nature, for example but not limited to retaining walls, landscaping walls, and decorative walls, must receive prior Board approval. Retaining walls on a property line shall be the responsibility of both the uphill and downhill neighbor. Any terracing must receive prior Board approval.
